This is the agreement you accept when you check the waiver box while reserving online (version wf-2026-07-29). Photo and video permission (Section 8) is a separate choice you make when reserving, and either answer is fine.
Reaction Lab — Minor Participation, Assumption of Risk, and Liability Release Agreement
Effective Date: the date of electronic acceptance ("Effective Date")
This Participation, Assumption of Risk, and Liability Release Agreement (this "Agreement") is entered into by and between Reaction Lab LLC, a New Jersey limited liability company with its principal place of business at 2347 NJ-36, Atlantic Highlands, NJ 07716 ("Reaction Lab," "we," "our," or "us"), and the undersigned parent or legal guardian ("Guardian," "you," or "your") acting on behalf of the minor child(ren) identified below (each a "Participant").
1. Description of Activities
Reaction Lab offers hands-on educational programs, demonstrations, workshops, birthday parties, camps, and events involving science, technology, engineering, art, and mathematics (collectively, the "Activities"). Activities may include, by way of example only and without limitation, small-scale chemical reactions using diluted reagents appropriate for classroom demonstrations, simple electrical circuits and low-voltage components, woodworking with hand tools, adhesives, low-temperature heat sources, dry-ice demonstrations, and other interactive or recreational activities or events that Reaction Lab may host from time to time.
2. Acknowledgment & Assumption of Inherent Risks
You understand and acknowledge that participation in the Activities involves inherent and unavoidable risks, which may include, but are not limited to:
- Minor cuts, abrasions, burns, bruises, sprains, or strains;
- Allergic reactions or skin/eye irritation from contact with diluted chemical reagents, food-grade acids/bases, colorants, latex, plant-based extracts, or similar substances;
- Exposure to communicable diseases (e.g., colds, influenza, COVID-19);
- Trips, slips, or falls on or about the premises;
- Damage to clothing, electronic devices, or other personal property;
- Misconduct or negligent acts by other participants or third parties;
- Serious injury or death in rare circumstances when unforeseeable events occur; and
- Any other risks, hazards, or dangers inherent in or incidental to the Participant's presence on the premises or participation in the Activities, whether or not described above.
Guardian voluntarily assumes all such risks—known or unknown, foreseeable or unforeseeable—on behalf of Guardian and each Participant.
3. Representations & Warranties
- Guardian is the lawful parent or legal guardian of the Participant(s) and has full authority to execute this Agreement.
- Each Participant is physically and mentally able to engage safely in the Activities and will properly wear all personal protective equipment ("PPE") that Reaction Lab provides or requires. If a Participant removes or refuses PPE, Guardian will immediately remove the Participant from the experiment area.
- Guardian agrees to disclose any allergies, medical conditions, or medications that could affect safe participation in science activities, and will update Reaction Lab before future visits if conditions change.
- Participant is not currently exhibiting symptoms of a communicable disease and has not been advised by a medical professional to self-isolate or refrain from participation.
4. Waiver, Release, Indemnification & Jury-Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY NEW JERSEY LAW, GUARDIAN, ON BEHALF OF GUARDIAN, THE PARTICIPANT(S), AND THEIR RESPECTIVE HEIRS, SUCCESSORS, ASSIGNS, AND PERSONAL REPRESENTATIVES, HEREBY IRREVOCABLY AND UNCONDITIONALLY:
- WAIVES AND RELEASES Reaction Lab, its owners, managers, employees, contractors, volunteers, insurers, landlords, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, or expenses (including attorneys' fees) arising out of or related to (i) the Participant's participation in or observation of the Activities, (ii) the Participant's presence on or about the premises, or (iii) any products, equipment, or materials supplied or used by Reaction Lab, INCLUDING CLAIMS ALLEGING THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY;
- COVENANTS NOT TO SUE any Released Party with respect to such claims;
- AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS the Released Parties from and against any claim brought by or on behalf of the Participant(s) or any third party arising out of the Participant's acts, omissions, or violation of the Facility Rules;
- WAIVES THE RIGHT TO A TRIAL BY JURY in any action or proceeding arising out of or relating to this Agreement; and
- LIMITS DAMAGES: In no event shall either party be liable for punitive or exemplary damages.
This waiver does not apply to claims resulting from a Released Party's gross negligence, willful misconduct, or reckless disregard of safety.
5. Medical Authorization & Liability for Costs
If Reaction Lab, in its reasonable judgment, determines that a Participant requires emergency medical care, Guardian authorizes Reaction Lab to (i) administer basic first aid and/or (ii) arrange ambulance transport and treatment by credentialed medical professionals. Guardian is solely responsible for all resulting medical costs. If Reaction Lab advances any such costs, Guardian will reimburse those costs within ten (10) days of written demand.
6. Property Damage
Guardian accepts financial responsibility for any loss of or damage to Reaction Lab property caused by a Participant's intentional, negligent, or reckless conduct (ordinary wear and tear excepted). Reaction Lab is not responsible for loss or theft of personal property brought onto the premises.
7. Facility Rules, PPE, and Conduct
Participants must:
- Wear PPE at all times while in designated experiment areas and keep it on until completely exiting the experiment area;
- Follow all posted rules, verbal instructions, and safety protocols;
- Treat equipment, materials, staff, and fellow participants with respect; no running, pushing, throwing of objects or substances, or other horseplay is permitted.
Reaction Lab may, in its sole discretion, remove the Participant and/or Guardian for any rule violation or behavior that jeopardizes safety or the learning environment. No refund will be issued for sessions forfeited due to rule violations.
8. Photography & Video (Your Choice)
Reaction Lab sometimes takes photographs or video during activities for its promotional and informational materials (online and offline). Whether your child may be featured in those materials is your choice, made where indicated at signing, and your choice does not affect participation.
If you grant permission, you authorize Reaction Lab to use photographs or recordings of your child—without further approval or payment—in any media (online or offline), anywhere in the world, for as long as Reaction Lab chooses.
If you decline, Reaction Lab will not intentionally feature identifiable images of your child in promotional materials and will make reasonable efforts to exclude your child from them. You acknowledge that your child may incidentally appear in the background of general photos or video of the lab, and Reaction Lab will take reasonable steps to avoid using identifiable incidental images of your child.
9. Parental Supervision Requirements
- Guardian agrees to actively supervise Participant(s) at all times during Open Lab sessions and to ensure continued compliance with safety protocols, including proper use of PPE.
- Guardian acknowledges that Reaction Lab staff provide instruction and periodic monitoring, but Guardian retains primary responsibility for moment-to-moment supervision.
- Failure to prevent prohibited conduct (including throwing objects or substances) constitutes a breach of this Agreement.
10. Term & Renewal
This Agreement is valid for one (1) year from the Effective Date and applies to each subsequent visit during that period unless earlier revoked in writing. A new waiver is required after expiration or if Participant information changes.
11. General Provisions
a. Severability. If any provision is held unenforceable, the remaining provisions remain in full force to the greatest extent allowed.
b. Governing Law & Venue. New Jersey law governs this Agreement. Exclusive venue lies in the state courts of Monmouth County or the U.S. District Court for the District of New Jersey.
c. Alternative Dispute Resolution. As a condition precedent to filing any lawsuit, the parties will attempt in good faith to resolve disputes through non-binding mediation in Monmouth County.
d. Updates. Reaction Lab may update this Agreement from time to time; such updates apply to future visits after written or electronic notice to Guardian.
e. Entire Agreement; Amendments. This writing constitutes the entire understanding and may be amended only in a signed writing (including electronic signature) by Reaction Lab and Guardian.
f. Electronic Signature. Electronic signatures carry the same legal effect as handwritten signatures under the New Jersey Uniform Electronic Transactions Act.
12. Acknowledgment & Signature
I HAVE CAREFULLY READ AND UNDERSTOOD THIS AGREEMENT. I AM AWARE THAT I AM WAIVING CERTAIN LEGAL RIGHTS ON BEHALF OF MYSELF AND THE PARTICIPANT(S). I SIGN VOLUNTARILY AND INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY EXCEPT AS EXPRESSLY LIMITED HEREIN.
